PetFamily Terms & Conditions

1. Description of the Service

PetFamily is a pet care app that helps you manage your pets. The App may include:

• Pet management: Create and manage pet profiles (name, species, breed, birth date, weight, photo, and related information).
• Tasks and routines: Create, edit, and complete tasks (e.g. walks, feeding, grooming) with optional reminders and recurring schedules.
• Health tracking: Record medications, health events (e.g. vet visits, vaccinations, weight checks), and weight history per pet.
• Calendar and search: View daily responsibilities and search across pets, tasks, and health events.
• iCloud sync (optional): Sync your data across your devices using your Apple ID and iCloud.

The App is provided "as is." We may add, change, or remove features over time. Your use of the App after any change constitutes acceptance of the updated Terms where applicable.

2. Eligibility

You must be at least 13 years of age (or the minimum age in your jurisdiction to consent to use of the App) to use PetFamily. If you are under 18, you should use the App only with the involvement of a parent or guardian. By using the App, you represent that you meet these requirements.

3. No Account Required (Basic Use)

You do not need to create an account or provide an email address to use the basic features of the App. Your data (pets, tasks, medications, health records) is stored on your device and, if you enable it, in your iCloud account. Subscription purchases are made through your Apple ID and are subject to Apple's terms and payment policies.

4. Acceptable Use

You agree to use the App only for lawful purposes and in a way that does not:

• Violate any applicable law or regulation.
• Infringe or misuse the rights of others (including intellectual property or privacy).
• Transmit harmful, offensive, or illegal content.
• Attempt to reverse-engineer, decompile, or extract the App's source code (except as allowed by law).
• Use the App to build a competing product or service.
• Circumvent or abuse subscription or access limits (e.g. sharing an account to avoid paying where a subscription is required).

We may suspend or terminate your access to the App if we reasonably believe you have breached these Terms.

5. Subscriptions and Payments

5.1 Premium features

Some features (e.g. multiple pets, unlimited tasks, premium widgets, iCloud sync) may require a paid subscription. Subscription offerings, prices, and terms are displayed in the App and may change with notice where required by law.

5.2 Apple as merchant

All in-app purchases and subscriptions are processed by Apple (StoreKit). Payment is charged to your Apple ID account. You agree to Apple's payment terms and any applicable subscription terms (e.g. auto-renewal, cancellation, refunds). We do not store your payment details; Apple does.

5.3 Refunds and cancellations

Refund and cancellation requests for in-app purchases are handled by Apple. Please use the report a problem flow in the App Store or contact Apple Support. We do not process refunds directly.

6. Your Data and Privacy

Your use of the App is also governed by our Privacy Policy. You consent to the collection and use of information as described there. Data you enter (pets, tasks, health records, etc.) is stored on your device and, when you enable sync, in your iCloud account. We do not sell your personal data or use it for advertising.

7. Intellectual Property

The App, including its design, text, graphics, logos, and software (excluding open-source components), is owned by us or our licensors. You do not acquire any ownership rights by using the App. You may not copy, modify, distribute, or create derivative works from the App or its content except as permitted by these Terms or applicable law. The name "PetFamily" and related marks are our property.

8. User Content and Responsibility

You are responsible for the accuracy of the information you enter (e.g. pet details, medication dosages, vet notes). The App is a tool to help you organize care; it does not provide veterinary, medical, or professional advice. Always consult a qualified veterinarian or professional for health decisions. We are not liable for any decisions you make based on data stored in the App.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. USE OF THE APP IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• WE (AND OUR AFFILIATES, LICENSORS, AND SERVICE PROVIDERS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, LOSS OF PROFIT, OR BUSINESS INTERRUPTION) ARISING FROM OR RELATED TO YOUR USE OF THE APP.
• OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR, IF GREATER, ONE HUNDRED U.S. DOLLARS).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another.

12. Termination

You may stop using the App at any time (e.g. by deleting it from your device). We may suspend or discontinue the App or your access to it, with or without notice, if we believe you have breached these Terms or for other operational or legal reasons. Upon termination, your right to use the App ceases. Sections that by their nature should survive (including Sections 7–11 and this Section 12) will survive termination.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, where appropriate, notify you in the App or via the App Store. Continued use of the App after the effective date of the new Terms constitutes acceptance of them. If you do not agree, you must stop using the App.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Argentina, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the App shall be resolved in the courts of the Province of Buenos Aires, Argentina. In-app purchases and subscriptions are processed by Apple Inc. and are subject to Apple's terms and the laws of the United States. If you are in the European Union, the European Economic Area, or another region with mandatory consumer protection laws, your statutory rights remain unaffected.

15. General

• Entire agreement: These Terms, together with the Privacy Policy and any in-app purchase terms, constitute the entire agreement between you and us regarding the App.
• Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
• No waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment: We may assign these Terms or our rights and obligations hereunder; you may not assign your rights under these Terms without our prior written consent.
